XPOSE TV Rokan Hilir Kasus Dugaan Korupsi Dana Desa 2023 – 2024 di Bagan Sinembah Utara, Riau
Arjuna Sitepu, Kepala Divisi Pengawasan dan Pencegahan Yayasan Dewan Perwakilan Pusat KPK TIPIKOR, secara resmi melaporkan Imbran Nasution, Penghulu Bagan Sinembah Utara ke Inspektorat Rokan Hilir, terkait dugaan penyimpangan dalam pelaksanaan proyek pembangunan drainase di Dusun Ampaian Rotan, yang didanai oleh Dana Desa (DD) Tahun 2023 – 2024. Kabarkannya kepada media ini, Sabtu (15/03/2025)
Temuan awal menunjukkan bahwa proyek tersebut tidak mencantumkan nilai anggaran pada papan informasi proyek, yang melanggar ketentuan transparansi pengelolaan keuangan desa, jelasnya.
Tim Yayasan KPK TIPIKOR menemukan indikasi kuat adanya pekerjaan fiktif dan mark-up anggaran dalam penyaluran Dana Desa Tahun 2023 – 2024. Beberapa proyek yang diduga bermasalah meliputi:
1. Pengelolaan Lingkungan Hidup Desa: 1 Paket senilai Rp 5.000.000.
2. Pembangunan/Rehabilitasi Prasarana Jalan Desa: 140 meter senilai Rp 82.040.000.
3. Pembangunan/Rehabilitasi Prasarana Jalan Desa: 100 meter senilai Rp 55.530.000.
4. Pemeliharaan Fasilitas Jamban WC Umum dan Pembangunan Tempat Parkir: 6 unit senilai Rp 11.866.000.
5. Penyelenggaraan Posyandu dan Operasional Pos Kesehatan Desa: Senilai Rp 6.000.000.
6. Operasional Pos Kesehatan Desa: Senilai Rp 13.600.000.
7. Bantuan Langsung Tunai (BLT): Untuk 45 KK dari Januari hingga Mei senilai Rp 81.000.000.
Selain itu, temuan serupa juga ditemukan pada proyek-proyek Dana Desa Tahun 2023, seperti:
1. Pembangunan/Rehabilitasi Sumur Resapan: 5 unit senilai Rp 75.560.000.
2. Penyelenggaraan Posyandu dan Operasional Pos Kesehatan Desa: Senilai Rp 15.641.600.
3. Pengelolaan Perpustakaan dan Tanah Bacaan: Senilai Rp 3.000.000.
4. Peningkatan Produksi Peternakan: Senilai Rp 167.389.600.
5. Pemeliharaan Sarana dan Prasarana Kepemudaan dan Olahraga: 29 unit senilai Rp 168.370.000.
Ketentuan Peraturan Perundang-Undangan:
1. Undang-Undang Nomor 6 Tahun 2014 tentang Desa:
– Pasal 32 mengatur bahwa pengelolaan keuangan desa harus dilakukan secara transparan, akuntabel, dan partisipatif.
– Pasal 33 mewajibkan adanya papan informasi proyek yang mencantumkan nilai anggaran, sumber dana, dan pelaksana proyek.
2. Undang-Undang Nomor 31 Tahun 1999 jo. Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi:
– Pasal 2 dan Pasal 3 mengatur tentang tindak pidana korupsi, termasuk penggelapan anggaran dan mark-up proyek.
– Pasal 5 mengatur tentang gratifikasi yang dapat dikategorikan sebagai tindak pidana korupsi.
3. Peraturan Menteri Desa, Pembangunan Daerah Tertinggal, dan Transmigrasi Nomor 8 Tahun 2022 tentang Prioritas Penggunaan Dana Desa Tahun 2023.
– Mengatur bahwa penggunaan Dana Desa harus sesuai dengan perencanaan dan prioritas kebutuhan desa.
Sanksi yang Dapat Diterapkan:
1. Sanksi Administratif:
– Pemberhentian sementara atau tetap dari jabatan bagi kepala desa atau pejabat desa yang terbukti melanggar.
– Pembekuan atau penghentian alokasi Dana Desa untuk desa yang bersangkutan.
2. Sanksi Pidana:
– Hukuman penjara maksimal 20 tahun dan denda maksimal Rp 1 miliar bagi pelaku tindak pidana korupsi sesuai Pasal 2 dan Pasal 3 UU Tipikor.
– Hukuman tambahan berupa pengembalian kerugian negara atau daerah.
Tim Yayasan KPK TIPIKOR akan melakukan investigasi lebih mendalam terhadap kasus ini, termasuk memeriksa dokumen proyek, mengaudit keuangan, dan memanggil pihak-pihak terkait untuk dimintai keterangan. Jika terbukti bersalah, Imbran Nasution dan pihak-pihak terlibat lainnya akan diproses sesuai hukum yang berlaku, terangnya
Kasus ini menjadi sorotan penting dalam upaya pemberantasan korupsi di tingkat desa. Yayasan TIPIKOR menegaskan komitmennya untuk memastikan bahwa Dana Desa digunakan secara tepat guna dan transparan, demi kesejahteraan masyarakat desa.
