TAKALAR – Kisruh perseteruan yang menghangat di SMK Negeri 3 Takalar beberapa waktu lalu kini menemui babak baru. Siswa SMK beserta para guru meminta kepala dinas pendidikan provinsi Sulawesi Selatan agar mengembalikan Nursalam, S.pd sebagai kepala sekolah di SMKN 3 Takalar yang sementara di non jobkan. 13/02/2025.
Tanggapan dari beberapa siswa, wakil kepala sekolah dan para guru membuat, mereka ingin agar persoalan intrik, fitnah dan sakit hati dari oknum guru yang beberapa waktu lalu terjadi bahkan sampai heboh di media agar segera di selesaikan dengan cara kekeluargaan. Beberapa sumber yang sempat ditemui awak media mengatakan jika pemberitaan yang selama ini di media hanya ingin merusak reputasi SMKN 03 Takalar, padahal apa yang utarakan lewat media tersebut sama sekali tidak benar dan hanya mendengar dari satu sisi.
“Kami melihat persoalan ini sebenarnya hanya kesalah pahaman saja, apalagi ini sebenarnya masalah pribadi, dimana jujur kami katakan ada faktor rasa tidak senang dari beberapa oknum guru yang tidak senang dengan kepemimpinan Nursalam,S.pd,” ungkap beberapa guru yang tidak ingin disebutkan namanya.
Bahkan beberapa siswa SMKN 3 Takalar yang ditemui berpendapat yang sama, bahkan para siswa meminta agar Nursalam,S.pd dikembalikan lagi sebagai kepala sekolah. ” Sewaktu pak Nursalam jadi kepsek setiap ada kegiatan selalu gratis, tidak pernah ada bayar bayar pak, bahkan setiap pulang sekolah kami biasa lihat pak kepsek keliling kelas merapikan bangku dan mematikan listrik, beda dengan kepsek sebelumnya ,” ungkap beberapa siswa.
Tanggapan Dari Segi Hukum
Direktur Pusat Kajian Advokasi dan Anti Korupsi (PUKAT) Sulsel, Farid Mamma SH.MH, menanggapi polemik yang terjadi di SMKN 3 Takalar menilai persoalan fitnah dan upaya menjatuhkan seseorang sama sekali tidak dibenarkan. Farid beranggapan, persoalan yang terjadi di internal SMKN 3 Takalar seharusnya bisa dilakukan dengan cara duduk bersama secara musyawarah.
Farid sempat menyinggung pemberitaan yang muncul di beberapa media akhir akhir ini dinilai menyudutkan Nursalam,S.pd sebagai kepala SMKN 3 Takalar, sangat tidak berimbang bahkan tanpa ada hak jawab atau klarifikasi langsung atau investigasi dilapangan.
Merujuk pada Pasal 310 ayat (1) KUHP
Barang siapa sengaja menyerang kehormatan atau nama baik seseorang dengan menuduhkan sesuatu hal dengan cara lisan, yang maksudnya terang supaya hal itu diketahui umum, diancam karena pencemaran dengan pidana penjara paling lama sembilan bulan atau pidana denda paling banyak Rp4,5 juta
Pada pasal 433 ayat 1 berbunyi : Setiap orang dengan lisan menyerang kehormatan atau nama baik orang lain dengan cara menuduhkan suatu hal, dengan maksud supaya diketahui umum, dipidana karena pencemaran dengan pidana penjara paling lama 9 bulan atau pidana denda paling banyak yaitu Rp10 juta.
