SULUT – XposeTV. Minta Polda Sulut Segera Menahan Para Pelaku Kegiatan PETI Di Lahan Sengketa Perkebunan Tumalinting,Ratatotok Satu. Polemik seputar exploitasi Pertambangan Emas Tanpa Ijin atau PETI di Kabupaten Minahasa Tenggara,Khususnya di lahan perkebunan Tumalinting Ratatotok Satu yang masih terus berlangsung hingga kini.
Menurut sumber (22/11/2024) yang telah mengetahui lama kegiatan Pertambangan Emas Tanpa Ijin dan pengrusakan lingkungan perkebunan,yang berdampak pada satwa liar,dan terjadinya banjir bandang,akibat dari pembabatan pohon atau tumbuhan lainnya.akan dibuatkan laporan resmi ke polda sulut tentang kegiatan ilegal ini.
Sumber yang namanya belum disebutkan meminta Kapolda Sulawesi Utara,Direktur Kriminal khusus Kombes Pol Ganda Saragih, lewatTindak Pidana Tertentu (Tipidter) segera merespon dan mengambil tindakan cepat,lahan sengketa yang sampai saat ini statusnya belum mempunyai kekuatan hukum tetap (Inkra)
Dikatakannya oknum YL dan SM telah melanggar pasal 221 ayat (1) KUHP dengan membuka paksa,garis polisi atau police line yang dipasang di tempat kejadian perkara yang telah terjadinya tindak pidana.

Diketahui ,sebelum menjadi lahan PETI,awalnya lahan tersebut merupakan milik dari Aneke Randang yang berlokasi di perkebunan Tumalinting Ratatotok Satu dengan memilki bukti register nomor 603/SU/RTS/III/2014 Folio nomor 86 dengan luas 14.625 M2 tapal batas tanah serta bukti bayar pajak sedangkan oknum terlapor YL terduga sebagai penyerobot hanya dapat menunjukan selembar alas hak tanpa gambar/denah berupa surat hibah tahun 1952 berlokasi di Bohongon.
Dengan jelas sumber (namanya di kantongi redaksi) minta kepada Aparat Penegak Hukum kali ini jangan sampai masuk angin pada proses pemeriksaan nanti,dan terutama oknum pelaku Pertambangan Emas Tanpa Izin PETI,segera lakukan pemanggilan terhadap mereka dan menjadikan tersangka dan bila perlu segera lakukan penangkapan.
PETI adalah kegiatan memproduksi mineral atau batu bara tanpa izin,tidak menggunakan prinsip pertambangan yang baik,dan berdampak negatif bagi lingkungan hidup,ekonomi dan sosial.
Pelaku pertambangan tanpa izin dapat dijerat dengan pasal 158 Undang Undang Nomor 3 Tahun 2020. Sanksi yang dapat dikenakkan kepada PETI adalah pidana penjara paling lama 5 tahun dengan denda paling banyak 100 miliar.
Dari pantauan media di lokasi sengketa masih ada aktivitas kerja yang dilakukan secara pasif dengan melakukan perendaman material,memasang tenda,namun ketika awak media mencoba melakukan investigasi untuk menemui oknum pelaku YL dan SM untuk diwawancarai,hanya terlihat para pekerja dan diduga kedua orang pelaku tersebut hanya memantau di tempat yang tidak bisa di jangkau oleh awak media.
