Arjuna Sitepu, pegiat anti-rasuah yang tergabung sebagai Kepala Divisi Pengawasan dan Pencegahan Yayasan Dewan Perwakilan Pusat Komisi Pengawasan Korupsi Tindak Pidana Korupsi (DPP KPK TIPIKOR), angkat bicara terkait surat yang dilayangkan Ketua DPD LSM Gakorpan ke SDN 019 Pandau Jaya, Siak Hulu, Kampar. Surat tersebut mendapatkan bantahan dari seseorang yang mengaku sebagai Pemimpin Redaksi (Pemred) Media Online (MO) Harimaupagi.com berinisial SM. Informasi ini diterima media pada Jumat (28/02/2025).
Arjuna, yang dikenal sebagai seorang aktivis senior dengan pengalaman di berbagai organisasi secara organisatori baik di tingkat daerah maupun pusat, menjelaskan bahwa Rahmad Panggabean, Ketua Dewan Pimpinan Daerah Gerakan Anti Korupsi dan Pemerhati Alam Nusantara (DPD GAKORPAN) Provinsi Riau, menuding pihak SDN 019 Pandau Jaya menjual Lembar Kerja Siswa (LKS). Namun, surat tersebut sebenarnya hanya berupa pemberitahuan terkait pengawasan, sesuai amanat Peraturan Menteri Pendidikan dan Kebudayaan Nomor 41 Tahun 2020 tentang Layanan Informasi Publik di Kementerian Pendidikan dan Kebudayaan.
Arjuna juga menyatakan kebingungannya mengapa Pemred Harimaupagi.com berinisial SM membantah tuduhan tersebut, bahkan menuding LSM GAKORPAN melakukan somasi ke pihak sekolah. Menurutnya, seharusnya bantahan tersebut datang langsung dari pihak sekolah, bukan dari orang yang mengaku sebagai Pemred media online, ada apa dengan Pimpred Harimaupagi.com ungkapnya.
Larangan Penjualan Buku LKS: Sekolah Negeri Vs. Sekolah Swasta.
Agar semua orang berhak tahu, terkait larangan penjualan buku LKS, tidak ada perbedaan antara sekolah negeri dan swasta. Keduanya sama-sama dilarang menjual buku LKS kepada siswa, tegasnya.
Hal ini diatur dalam Peraturan Menteri Pendidikan dan Kebudayaan (Permendikbud) Nomor 8 Tahun 2016 tentang Buku yang Digunakan oleh Satuan Pendidikan.
Permendikbud ini menyatakan bahwa sekolah tidak boleh memaksakan siswa untuk membeli buku LKS atau bahan ajar lainnya, baik secara langsung maupun melalui pihak ketiga.
Dasar Sanksi dan Peraturan Perundang-Undangan
1. Peraturan Menteri Pendidikan dan Kebudayaan Nomor 8 Tahun 2016:
– Pasal 3 ayat (2) menyatakan bahwa sekolah dilarang memaksakan pembelian buku LKS kepada siswa.
– Pasal 6 ayat (1) menyebutkan bahwa pelanggaran terhadap ketentuan ini dapat dikenai sanksi administratif, mulai dari teguran hingga pencabutan izin operasional sekolah.
2. Undang-Undang Nomor 20 Tahun 2003 tentang Sistem Pendidikan Nasional:
– Pasal 50 ayat (3) mengamanatkan bahwa pemerintah dan pemerintah daerah wajib menjamin terselenggaranya pendidikan yang bermutu bagi setiap warga negara tanpa diskriminasi.
– Pasal 53 ayat (1) menyatakan bahwa penyelenggara pendidikan yang melanggar ketentuan dapat dikenai sanksi sesuai dengan peraturan perundang-undangan.
3. Undang-Undang Nomor 17 Tahun 2013 tentang Organisasi Kemasyarakatan:
– Pasal 5 ayat (1) memberikan kewenangan kepada LSM untuk melakukan pengawasan sosial (social control) terhadap penyelenggaraan pendidikan, termasuk dalam hal penjualan buku LKS.
Tindakan LSM GAKORPAN
Sebagai bentuk pengawasan sosial berdasarkan amanat Undang-Undang No. 17 Tahun 2013, LSM GAKORPAN wajar menyikapi adanya penjualan buku LKS di sekitar sekolah yang diduga melibatkan oknum kepala sekolah.
“Hal ini dilakukan karena banyaknya aduan dari orang tua murid mengenai tingginya harga buku LKS yang diperjualbelikan di sekitar sekolah,” jelasnya.
Lebih lanjut, dia menjelaskan bahwa larangan penjualan buku LKS oleh sekolah, baik negeri maupun swasta, telah diatur secara jelas dalam peraturan perundang-undangan yang telah disebutkan di atas.
“Pelanggaran terhadap ketentuan ini dapat dikenai sanksi administratif hingga pencabutan izin operasional sekolah,” pungkasnya.
Oleh karena itu, penting bagi semua pihak, termasuk LSM, untuk terus melakukan pengawasan guna memastikan bahwa hak-hak siswa dan orang tua murid terlindungi dari praktik-praktik yang merugikan, ucapnya.
Harapannya kepada aparat penegak hukum (APH), dengan informasi dan penjelasan mendetail ini, kasus ini menjadi lebih spektakuler untuk ditindaklanjuti sesuai peraturan hukum yang berlaku. Penjelasan ini juga memberikan pemahaman yang jelas sebagai jawaban atas pemberitaan Pimpred Media Online (MO) Harimaupagi.com dengan judul “Polemik Penjualan LKS Di Indonesia, Siapa Yang Dirugikan Dan Siapa Yang Diuntungkan: Mengapa LKS Bisa Dijual Bebas Di Sekolah Swasta?” yang terbit pada 27 Februari 2025, serta para wali murid mulai Sabang sampai Tanah Papua agar mengetahui larangan penjualan buku LKS dan dasar hukum serta sanksi yang berlaku terhadap pihak-pihak yang terlibat,” tutup Arjuna Sitepu, yang juga merupakan Ketua Dewan Pimpinan Cabang GAKORPAN Kabupaten Rokan Hilir.
